At a Council held at Perth Amboy April 25th 1724 Present His Excellency William Burnet Esq' Governour & John Hamilton David Lyell John Parker John Johnston Jun' Daniel on the Demise of Vaughan vers Woodruff the Petition of Edward Vaughan was read Setting forth that the lease of Jacob Daniel on the demise of the petitioner for lands and tenements in Elizabeth town in the county of Essex in An Action of tresspass in Ejectment ag* Joseph woodruff does Expire on the 24th of July next and praying a Deffinitive Sentence in this cause or an Enlargement of the term of y Lease Which being read and considered and this board finding that by An order thereof made ye 29th of April 1723 the record in this cause was returned back to the Supream court to be Examined and amended by the record remaining there And that the Said transcript has not been as yet returned to this board Ordered that the petitioner do procure the said Record to be brought up by one of the Justices of the Supream Court that this board may proceed thereon And that the petitioner may have a copy of this minute At A Council held at Perth Amboy the 29th of April 1724 William Trent Esq' chief Justice of this province according to Order of the 25th Instant Brought up to this board the record in the cause Depending viz Jacob Daniel at the demise of Edward vaughan vers Joseph woodruff William Bradford laid before this board a warrant to him for fifty pounds for two years Sallary as printer Ending the 29th of Sep 1720 bearing date the fifth day of may 1722 which warrant is directed to William Eier Esq' treasurer and the said William Bradford Acquainted this board that the present treasurer Mr Kearny scrupled the payment of the Said warrant because it is not directed Also to the treasurer for the time being Ordered that the present Treasurer or Either of them do pay the Said warrant weh with a Copy of this Order shall be A sufficient discharge to him for so much Woodruff plaintiff in error ver Daniel on the Demise of Vaughan Mr Kinsey of Council for the plaintiff in Error attending was called in and being ask whether he would consent to the lenghtening of the Term of the Lease to Jacob Daniel in this cause he Answered he would [could] not till he had adviced with his Clyents and [prayed] time till fryday morning to advice with them which is granted him by this board Peter Keightly who lives on one of the Branches of the north branch of Rariton haveing hereto fore made complaint to his Excellency that it is not Determined or known whether the place where he lives be in Essex Hunterdon or Somerset county & that he has been often taxed in Each of them & otherwise required for the Service of Each of yo said countys by the officers thereof and prayed that directions might be given to the officers of some one of y° Said countys to tax him as in their county And that the officers of y° other two Countys be directed to desist in any way molesting him untill it be Determined in which county the place whereon he lives does lye On motion of m' Alexander reminding his Excellency hereof Ordered that the said Peter Keightly for the place he now lives on be taxed and do all other services as if the same place were determined to be in Somerset county And Ordered that no majestrate or officer of y° Countys of Essex or Hunterden do in any way molest the said Peter on pretence of his being in their county untill it be determined in which county the said place is At a Council Held at Perth Amboy the first Day of may Woodruff Plaintiff in Error Daniel on the Demise Mr Kinsey council for the plaintiff in Error Attending pursuant to An Order of this board of y 29th past consents of Edwd Vaughan to Enlarge the Said Lease Ordered by consent of both partys that the Term of the Lease of Jacob Daniel on the Demise of Edward vaughan for lands and tenements in Elizabeth town in the county of Essex in An action of tresspass & Ejectment agt Joseph woodruff Defft on A writ of Error before this board be Enlarged for one year after the Expiration of the present term of y Lease1 This action was brought at the November Term, 1714, of the Supreme Court, in the interest of the East Jersey Proprietors, to test the validity of the patent for Elizabethtown, granted by Governor Nicolls, of New York, in disregard of the Proprietors' title from Berkley and Carteret. The Court decided, May Term. 1718, in favor of the Rev. Edward Vaughan, the plaintiff. Woodruff brought the case, by a writ of error, before the Governor and Council, as the Court of Errors, but that Court deferred action from time to time for ten or twelve years, when the case was dropped. -Elizabethtown Bill in Chancery, 46, 122; Answer, 32. |
