Att a Councill held at Perth Amboy July ye 19th 1726 The Petition of Catherin Lyell David Lyell Catherin Lyell Jun' and Fenwick Lyell Ex" of the last will & testamt of David Lyell Esq' deceased one of y ComissTMs of ye Loan office Setting forth that the Said David Lyell in his lifetime served as one of the Comissioners of the Loan office about 22 months and that he has not had the Sallary but of twelve months therefore they humbly pray they may be allowed for the time the S David Lyell had y' office aforesaid Ordered that m' Lawrence Smith the present Comissioner of the Loan office be Served with the Copy of the petition And that he lay before this board to morrow what objection he has to the said Petition ray of Council for the Deffend in Error Acquainted this board that on thursday last they had Sent a messenger on purpose to New York to Serve y° Deffts Councill with notice that they had Entered A non pross for want of assigning Errors but that if they wold assign them forthwith and come to hearing this day they wold waive the non pross and Argue the Errors this day wch matters the Deff Councill offered to prove by the oath of Humphrey Clay Jun' then attending but it appearing to this board Confessed under the hand of John Chambers of Councill for yo plaintiff that he was served with notice on the fourth of may last to Certify the record in ts Eight days time after notice and to assign Errors in Eight days after or that a non pross was to be then Entered which hitherto has in no ways been Complyed with on the part of the plaintiff and it appearing also under his hand that he was served with notice of An offer to waive the non pross as afores are [and] to Come to A hearing this day It is the opinion of this board that the reason for Setting a side the non pross offered by the Letter of the Complainants Councill are not suff to Sett it aside and therefore it is hereby Ordered to Stand in force And it is further Ordered that John Parker Esq' do Tax the Costs of y Deff* in this Cause Mr Kearny Treasurer of the Eastern Division Acquainted this board that moses Rolfe Esq' Collector of the County of midlesex had not hitherto paid to him the moneys Raised in the Said County for the thousand pound tax laid by the Act for an additional Support of Government and makeing Current fourty thousand pounds in Bills of Credit for that and other purposes therein mentioned And it appearing by that Act And the Act referred to therein the Same ought to have been paid on or before the Second tuesday tuesday in Janry last under the penalty of fifty pounds Ordered that he do pay the Said money raised in the Said County on or before fryday next & on failure thereof that the attorney Generall do prosecute him for the Same & for the penalty afores and that he be forthwith Served with the Copy hereof Mr Michael Kearny Treasurer of the Eastern Division of New Jersey Delivered to this board the Sum of four hundred & twenty pds four shills proc money being part of raised out of the Eastern Division of the province & by virtue of An Act Entituled An Act for an additional Support of Government and makeing Currt fourty thous pounds in bills of Credit for that & other purposes therein mentioned And are as followeth All which Bills were Cancelled before this board According to the Directions of the Said Act of assembly And According to an other act of assembly Entituled An Act concerning the appointment of Comiss" of the Loan offices and concerning the Sinking of four thous pounds of Bills of Credit reference being had to the afores acts Att a Councill held att Perth Amboy July 20th 1726 Present Mr Smith & m' Lyell attending to Speak to the petition of the Execut" of David Lyell deceased who both Submitted to what determination this board Should give upon the matters of y' petition & both partys being heard thereon the partys with drew And this board takeing the matters aforesaid into Consideration are of opinion that the yearly Services of the Comiss" of y Loan offices consists of two parts the first is the Letting out the money's på into their hands and yo Second is to receive in the moneys So lett out from the borrowers with the intrest for the Same And tho the receiveing back the moneys & intrest from the borrowers is done after the End of y year yet it's to be lookt upon as part of the Service of the former year And that Seeing the Letting out of the moneys Ends the Second Tuesday of June yearly its allmost indifferent whether the death of a Comiss' be Sooner or Later after that day until y 25th march there after and the Like Sallary Seems due to their Executs Wherefore as the testator com |
