come to their hands to the treasurer thereof tho' they have been expressly above five weeks agoe required to do it by the 7th of this Instant

Ordered that the attorney do prosecute every of the Said defaulters unless the treasurer of the Eastern Division Shall Acquaint in Eight days after y° present day that they have paid the Same

And it is further Ordered that the Treasurer do forth with acquaint the Defaulters thereof that unless they pay the Same to him on or before fryday the fifth day of January next they will be forth with prosecuted And that the Clerk of the Councill do Serve the Treasurer with A Copy of this Minute

His Excellency Ordered the Secro' to acquaint the Generall Assembly that he Expected their Attendance Imediately

the Generall Assembly Attended and his Excellency gave his Assent to An Act for vesting the right of Election of representative to Serve in the generall assembly of this province in the County of Hunterdon in y° Western Division thereof and for Suspending the choise of the town of Salem Untill Some future provision be made

Mr Bard took the Usual oaths appointed by the Act Ordered that m' Bard be added to the Comittee appointed the 11th of December last to Examine the treasurers Acce and that the sa Comittee or any three of them be like wise a Comittee to Join a Comittee of the assembly to examine the accts of m' Eiers late treasurer of the Eastern Division of this province

A Message from the house by Coll ffarmer & m2 Sonmons desireing that a Comittee may be appointed to Join A Comittee of that house to Consider of a proper method for redressing the hard Ships the province Labours under in respect to the times appointed for the Sitting of y° Severall Courts & in relation to the fees now taken

Ordered that the above Comittee or any three of them be a Comittee for the Said purpose & that the Clerk of the Councill Acquaint the house there with

his Excellency laid before this board the following Instructions

22 And Whereas great mischiefs may arrise by passing bills of an Unusuall and Extraordinary nature and importance in the plantations all bills remaining in force there from the time of enacting untill our pleasure be Signyfied to the Con

trary We do hereby Will and require you not to pass or Give your Consent here after to any bill or bills in the assembly of our Said Province of Unusuall and Extrordinary nature & Importance wherein our prerogative or the property of our Subjects may be prejudiced or the trade or Shipping of this Kingdom Any ways affected Untill you Shall have first transmitted unto us the Draught of Such A bill or bills and Shall have read our Royall Pleasure thereupon Unless you take Care in the passing of any Bill of Such Nature As before mentioned and therebe a Clause Inserted therein Suspending and deferring the Execution thereof untill our pleasure Shall be known Concerning the Same Which you are Likewise to Observe in the passing of all Acts that Shall repeal any Act or Acts that have had the Royal Assent

Part 37 And you Shall not re-enact Any Law to which our assent has been once refused without our Express leave for that purpose first Obtained from us upon A full representation by you to be made of the reasons & necessity for passing Such Laws

The Bill intituled An Act for Shorting of Law Suits and regulating the practice & practitioners of the Law & other officers was read the Second time and Comitted to the Gentlemen of the Councill or any five of them

A Message from the assembly by m' Harrison & m' Hall with a Bill Intituled An Act for Lessening the Sallarys of the Comissioners appointed to manage the Loan offices in the

Severall Countys of this province to which they desire y Concurrence of this Bord

Ordered the Said bill be read; The Said Bill was read the first time & ordered A Second reading

Collonell Johnston Chairman of the Comittee to whom was referred y bill intituled An Act for preventing malitious prosecutions and other Suits of the Crown and rectifying Sundry abuses thereof Reported that they had gone through the Said bill without any Amendments

Ordered the Said bill be read, the Said bill was read the third time

Ordered the Said bill do pass & that Coll Johnston do Acquaint the house of representatives that this board have passed the Said Act with out any amendment

Peter Bard Esq' Chairman of the Comitte to whom was Referred the bill intituled An Act prescribing the form of declaration of fidelity the Effect of y° abjuration oath & affirmation Instead of the form hereto fore required And for repealing the former acts in the Like cases made & required Reported that they had gon through the sd bill and made Some amendm thereto-Ordered the bills with the Amendments be read, the Said bill with the Amendments was read A third time & passed as amended-Ordered that m2 Bard do Carry the bill with the amendmts to the Assembly and desire their Concurrence thereto

Mr Smith Chairman of the Comittee to whome was referred the bill Intituled An Act to prevent the Concealing of Stray Cattle horses & Sheep reported that they had gone through the Said bill and made Some Amendments thereto Ordered the Said bill with the Amendments be read

the Said bill with the Amendments was read a third time & passed as Amended Ordered that m' Smith do Carry y bill with the Amendments to the assembly and desire their Concurrence thereto

His Excellency Acquainted this board that he haveing Seen in the minutes of the assembly of yesterday A resolve for an address to his majesty to have a Seperate Governour for this province from that of New York he was Concerned to find any Such attempts at this time and therefore had adjourned them till thursday In Order that he might have time to represent to them as private men the impropriety of Such an attempt and to See if they would intirely desist from further proceeding in it, and if they would not be convinced So to do that he was resolved no farther to Act with them And in Order to discourseing freely with them on this head he had Sent to the Speaker to Come hither with the members as private persons after Some time the Speaker with about Eighteen of the members Attending came in And being Seated his Excellency Spoke to them to the purpose aforesaid and assured them that he would not think of meeting further with them unless they gave him assurance before hand of their desisting from further proceeding on the point aforesaid
