N Treating of this Affair, and to fet forth of what Kind and Nature theThing is (inRelation to the Roman Catholicks, Nonfurors, and others, interpreted as Delinquents) here ftil'd by the Name of PoPISH RECUSANCY; and alfo That which is called CONVICTION thereupon, and in what Manner, under their feveral Defcriptions, they are to be defined, and underflood; and how they come under the Cognizance of the Laws, OR NOT, it will be very proper, and applicable, to introduce the State, and Merits of a Cafe, parallel to the Matter in Hand interfperfing the Subject before us, throughout, with Imbellishments of Authorities out of the Canon, Civil, Statute, and Common Law, to fupport the Validity of the Reafonings thereupon: Whereby the naked Truth will appear in a clearer Light and View, to a judicious Obfervation; and, from a precedented Example, we may form Idea's fuitable to the fent Purposes. The Matter of Fact is thus: Dr. Welton, Rector of the Rectory and ParishChurch of St. Mary Matfellon, alids, White-Chapel in the County of Middlefex, 1697. was, in the Year 1697, prefented, by the lawful Patron, to that Living, then become vacant by the Death of Dr. Payn, the late Incumbent; and, thereupon, receiv'd Institution, and Induction, and has, ever fince, continu'd Rector there : He is alfo Vicar of the Vicarage of EaftHam in the County of Effex, where he refides.

In September and October 1715, Doctor September Welton was oblig'd to be in the CounOctober. try, near an hundred Miles from Home; whereupon, fome Perfons, having finifter Views against him, laid hold of that Opportunity, and procur'd him to be fummon'd to appear at the Quarter-Seffions in Effex, to take the Oaths there; which was done in the following Manner.

Randolph Faint, one of the Con-Saturday, ftables of the Parith of Low Layton, Octob. 1, in the County of Effex, made Oath. before the above-mention'd Juftices, that on Friday, the 30th of Septem ber, (which was the Day before) in the Forenoon, he left the faid Summons at the Dwelling-House of the faid Doctor Welton, in the Parish of Eaft-Ham, with the Wife of the faid Doctor; [as by the Return of the faid Juftices, in the Certification by the Clerk of the Peace for the County of Effex, appears.]
