Parfon, Incumbent, and Rector of the faid Rectory of the Parish and Parish-Church of St. Mary Matfellon, aliàs White-Chapel, and hath hitherto, as he ought, peaceably and quietly held, poffefs'd, and enjoy'd the fame. And the faid Reetory, or Living, is not vacant, but now full by his Incumbency therein. And this was and is true, publick, and notorious. Ponit tamen de quolibet alio temporis fpatio, &c. Item, That the faid Dr. Richard V. Welton, being legally inftituted and inducted into the faid Rectory of the Parish and Parish-Church of St. Mary Matfellon, aliàs White-Chapel, as in the fecond precedent Article of this Allegation is mention'd and fet forth, hath thereby not only had and obtain'd the Cure of Souls within the faid Parish; but is alfo thereby intitled to the Freehold of the faid Parish-Church, and to the Tythes, Manfe, Glebe, and other Profits and Perquifites thereunto belonging. And having had and been

in peaceable and quiet Poffefhon of his faid Living, Rectory, and Freehold, for the Term of Years in the fourth precedent Article of this Allegation mention'd, qught not to be difturb'd, amov'd, or diffeiz'd of his faid Living, Rectory, and Freehold, unless legally depriv'd, according to the Laws, Cuftoms, and Conftitutions of this Realm, but ought to hold and enjoy the fame during the Term of his natural Life. Item, That the faid Doctor William Shippen, by feeking and endea vouring to obtain Inftitution and Induction into the faidChurch of WhiteChapel aforefaid, feeks and endeavours to deprive and amove the faid Doctor Richard Welton of and from his faid Rectory, Living, and Freehold, and of the Tythes, Manfe, Glebe, and other Perquifites and Profits thereunto belonging, and the Cure of Souls in the faid Parish. Item, That the faid Dr. Richard VII. Welton is a pious, able, learned, orthodox, and eminent Divine of the Church of England; and in the Difcharge of his Prieftly Function and Duty, and his edifying Conversation amongst his Parishioners and Flock, has justly engag'd their Refpect and Efteem; and for and as a Perfon of the Character mention'd, the faid Doctor Welton was and is commonly accounted, reputed, and taken to be. Et ponit ut fupra.

Item, That the faid Dr. Richard VIII. Welton hath not at any Time been guilty of any Crime, Mifdemeanor, or Fault, whereby to have incurr❜d or to incur any Ecclefiaftical Cenfure or Canonical Punishment of Deprivation or Amotion, nor has made any Ceffion or Refignation of his faid Living or Rectory of WhiteChapel aforefaid. And this was and is true, publick, and notorious. Et ponit ut fupra.

Item, Whereas a Copy of a pre- IX. tended Writing has been exhibited

in this Caufe, pretended to be a Copy of a pretended Certificate of a pretended Conviction, the fame is a private Writing, and ought not by Law to be admitted. And in Cafe the fame did relate to Dr. Richard Welton, Party in this Caufe, (Quod non fatetur Pars ifta proponens,&c.) fuch pretended Certificate of Conviction was unduly and illegally abtain'd and made, and is in it felf irregular, illegal, null, and of none Effect, at least fufficient in Law, as the Party proponent is advis'd, to found a Deprivation or Amotion upon; and the faid Certificate is not authentick, nor are the Contents thereof true, Et ponit ut fupra.

Item, That in Cafe the faid Do&or William Shippen hath, as is pretended, obtain'd any pretended Prefentation to the faid Living or Re&ory of White-Chapel aforefaid, the fame is unduly obtain'd and made, and in it felf null and void, being fo obtain'd, before the faid Living (not becoming void by Death, Ceffion, or Refignation) is actually declar'd,

clar'd, by legal Procefs, Proceedings, and Proofs, to be vacant. And farther, for that the Perfon or Perfons pretending to make fuch Presentation, is not, nor are the rightful, lawful, and undoubted Patron or Patrons thereof: And that the pretended Grounds upon which the faid pretended Prefentation is founded and granted, are fictitious, and such as by Law ought not to be admitted, as will appear by the faid pretended Prefentation when produc'd,and the Party proponent has Liberty to object to the fame, which he prays may be exhibited according to Order of this Court. Item, Quod pramiffa omnia & fin- XI. gula fuerunt, & funt vera, publica, manifefta, pariter ac famofa, ac de & fuper eifdem laborarunt & in præfenti laborant publica Vox & Fama. Unde factâ fide, &c.
