The Nullities and Abfurdities of this Certificate (exhibited) have been mention'd before; and that it is altogether incongruous with the Act of Parliament, will plain enough appear by what has been obferv'd already, and by fome few farther Remarks upon the Matter.

OBJECTIONS to the Proceedings, in relation to the obtaining of the Certificate.

First, As to the Precipitancy.

The Certificate of the Juftices, dated the very Day prefix'd the Doctor to take the Oaths.

That the Day, fo prefix'd, was that wherein Minifters (of the Gofpel) are preparing to compofe their Sermons, for the Inftruction and Edification of the Flock committed to their Charge.

*That no Man is compellable to an Impoffibility; 'tis notorious that the Doctor could not (poffibly) have Notice of the Summons, (at the great Distance he was) fo as to attend at the Time and Place thereby requir'd. And it would be an equal Opportunity, (for any one having finifter Ends) to procure any Perfon (even the Bishop himself, happening to be upon upon Vilitation, or other Avocation, in remote Parts of his Diocefe, or elfewhere abfent to be fummon'd, (in his Abfence) and ob tain a Conviction, before he could have Notice of, or be privy to, fuch Summons.

and Errors of all the Pro-

This imports as if he was Clerk of the Peace by an Act of Parliament in that Year; whereas it fhould have been,

Ego Samuel Reynolds, Ar',Clericus Pacis Com Effex' preď, humillimè certifico, Virtute cujufdam Actus Parliamenti, &c.

His Certification is made, directed II. thus:

"Sereniffimo Domino Regi, in "Cur' ipfius Domini Regis, coram ipfo R "Rege apud Weftm' in Com' Midd..

Whereas it ought to be certify'd into the Court of Chancery, or King's Bench, the A& thus requiring: And the fame thall be from thence certify'd by the Clerk of the Peace .of fuch County, &c. into his Majefty's High Court of Chancery, 02 King's Bench, there to be recozded amongst the Rolls of the faid Courts, in a Roll o2 Rolls there to be provided and kept for that Purpose only.

It should therefore have been,

Sereniffimo Domino Regi in Supremá Curiâ Cancellarie; or, in Curiá ipfius Domini Regis ad Placita, coram ipfo Rege, &c.

Or elfe, what Court is defcrib'd thereby? For all the Courts at Westminster are the King's Courts and the King's Bench is always diftinguifh'd, and call'd Curia Domini Regis ad Placita, coram ipfo Rege,&c.

The Certificate runs thus: "Certifico, Quod ad General' Quarte"rial' Seffion' Pacis dicti Domini

Whereas the Act requires the Return to be made to the next General Quarter-Seffions.
