7. That the said corporation of the town of Saint Boniface shall have all the powers necessary for levying, in the manner intended by the said Act, chapter ten of the Consolidated Statutes of Manitoba, on the taxable property of the said town the sums necessary to effect the payment of the said sum of sixty thousand dollars and interest thereon.

8. That the said sum of sixty thousand dollars be used first in payment of the debts which will be transferred to the town of Saint Boniface by the municipality of Saint Boniface and. the residue in the manner that the council may deem meet for the aforesaid ends.

9. The present by-law will be submitted to the property holders of the said town of Saint Boniface on the ninth day of June, A. D., 1883.

10. The present by-law shall come into force immediately after its publication.

CAP. LXXX.

An Act to Incorporate the two Towns of Emerson and West
Lynne into one Municipal Corporation, under the name of
the City of Emerson.
[Assented to 7th July, 1883.]

Whereas the corporation of the town of Emerson and the corporation of the town of West Lynne, are adjoining municipalities, and were heretofore each duly incorporated under the Statutes of the Province of Manitoba respecting Town Corporations.

And whereas the said two municipal corporations desire with certain adjacent territory to be united into one municipal corporation under an entirely new and distinct Charter or Act of incorporation with the powers hereinafter set forth.

And whereas the said two town corporations have presented their petition praying for an Act of this Legislature for the purposes aforesaid and it is expedient that the prayer of the said petition be granted.

Therefore Her Majesty by and with the abvice of the Legislative Assembly of the Province of Manitoba, enacts as follows:

1. From and after the passing of this Act the land, territory the City of and property lying within the following limits, namely, commencing at a point on the International Boundary line between the Province of Manitoba and the United States of America, immediately and due south of the south-east corner of section six, in township one, range three east of the principal meridian in this Province, thence north along the eastern boundary of the said section number six and continuing along the eastern limits of lots numbers eighteen, twenty, twentytwo, twenty-four, twenty-six, twenty-eight, thirty, and thirtytwo to the southern boundary of lot number thirty-four, thence east along the southern boundary of the said last mentioned lot to the south-east corner thereof, thence north along the eastern limits of lots thirty-four, thirty-six, thirty-eight and forty, thence west along the northern limit of the said lot number forty, and continuing in the same course along the northern limit of lot number thirty-nine to the north-west corner thereof, all of which last mentioned lots are shown on the Dominion Government survey of the Parish of Ste. Agathe, in this Province, thence in a right line to a point on the eastern limit of fractional section number fourteen in township one, range two, east of the said principal meridian, which point is on the centre line of the said section dividing the same into north and south halves, thence west along the said centre line

and in the same course along the centre line dividing in a like manner section fifteen in the same township to the western limit of the said last mentioned section, thence south along the western limit of the said section fifteen and continuing in the same course along the western limit of section ten in the same township to the south-east corner of section nine in said township and range, thence directly south along the western limit of river lots, numbers fifteen, thirteen, eleven, nine, seven, five, three and one, to a point on the International Boundary line, thence east along the said International Boundary to the place of beginning, shall form the territorial extent of, and the said above described boundaries shall be the boundaries and limits of the city of Emerson.

2. That from and after the passing of this Act the inhabi- Inhabitants of tants of the city of Emerson as herein before described and their ritory to be a successors shall be and are hereby declared to be a body corporate body politic and corporate in fact and in law by the name of "The "City of EmCity of Emerson" and separated from the other municipalities to which they formally belonged for all municipal purposes and by the same name they and their successors shall have perpetual succession, and shall have power to sue and be sued, implead and be impleaded, answer and be answered unto, in all courts and in Rights and all actions, causes, suits of law or equity whatsoever, and shall liabilities of have a common seal with power to alter and modify the same at their will and pleasure, and shall be in law capable of receiving by donation, acquiring, holding and departing with any property, real or moveable, for the use of the said city, of becoming parties to any contracts or agreements in the management of the affairs of the said city, and of giving or accepting any notes bonds, obligations, judgments, or other instruments or securities for the payment of any sum of money borrowed or loaned, or for the executing or guaranteeing of any duty right or thing whatsoever, and for the payment or securing the payment of any money borrowed, of paying loans made or debts owing by the said City of Emerson," or of taking up bonds that may become due, or for the purpose of making a loan or loans, or for any other legitimate and sufficient purpose whatsoever, the said City may grant and issue bonds for the sum or sums of money therein to be specified under the provisions hereinafter set forth, payable at such time and times after the granting and issuing thereof,and in such place or places in this Province, in the Dominion of Canada, in the United States of America, in any part of Great Britain or elsewhere, and either in the currency of the Dominion or in sterling money of Great Britain, or in the currency of the country where the same may be respectively made payable, as by the said city may be thought advantageous or expedient. Provided always that the said council shall not make or give any bond, bill, note, debenture or other undertaking for the payment of a less sum than

one hundred dollars; and any bond, bill, note, debenture or Proviso as to other undertaking issued in contravention of this section shall be void. Provided always, that nothing herein contained shall be construed to authorize the said council to issue notes to circulate as those of a bank.

3. The city shall be divided into six wards to be called respectively, number one, number two, number three, number Composition of four, number five, and number six wards, and the boundaries of said wards shall be as follows:

WARD NO 1.

Ward number one (1) shall be bounded as follows:- Begin ning at a point on the Red River, in the centre of Second street, thence north along the centre line of said street and to the end thereof, thence north in a right line to the centre of Hope street, at the south end of said street, thence north along the centre of Hope and Dufferin streets to the northern boundary of the city, thence east along said northern boundary of the city to the Red River, thence along the bank of said river to place of beginning.

Ward number two (2) shall be bounded as follows:-Beginning at a point on the Red River in the centre of Third street, thence north along the centre line of said street and to the end thereof, thence north in a right line to the centre of Lake street, at the south end of said street, thence north along the centre of said street to the centre of King street, thence west along the centre of King street to the western limit of the city, thence north to the northern limit of the city, thence east to the western boundary of ward number one, thence south along said boundary to the Red River, thence along the bank of said river to the place of beginning.

WARD NO. 3.

Ward number three (3) shall consist of all that portion of the city of Emerson on the west side of the Red River lying and being to the south of the centre line of King street and west of the centre line of Third street.

Being east of the Red River, and composed of all that territory lying between the Red river and the centre of Main street as shown on the registered plans Nos. 1 and 2.

WARD NO. 5.

Being east of the Red river, and being composed of all that No. 5. territory lying south of the centre of Dominion street, as shown on the said plan, and east of the centre of Main street, and the south half of section six, township one, range three east of the principal meridian aforesaid.

WARD NO. 6.

Being all the remaining territory of the said city lying east No. 6. of the Red River not included in wards four and five, and being north of the centre line of Dominion street and north of the south half of section six, township one, range three, east of the principal meridian.

4 The Lieutenant-Governor in Council shall on or before Piace and time of holding first the twentieth day of July of this year, by proclamation, name election. the place and time of holding the first election under this Act to fill the offices of mayor and aldermen for the city of Emerson, and the name of the returning officer appointed to hold such election, and the place of holding the first meeting of the council, and it shall be the duty of the Provincial Secretary to publish such proclamation forthwith in the Manitoba Gazette.

Any male inhabitant, of either of the said towns or- Qualification added territory, who is a British subject by birth or naturaliza- of voters. tion, over twenty-one years of age, who has been assessed for real property to the amount of $100, or personal property to the amount of $200, or who is a householder or tenant paying a yearly rental of at least $20, or who is assessed on an income of $800 per year, and who shall on that day adduce before the said respective mayors proof of the above requirements and qualifications to the satisfaction of said mayors respectively, shall be entitled to have his name added to the said voters' lists, of each ward in which he is qualified.
